Boat Lift Out Damage...Who Is Liable?

I had a boat lifted out today and on the first attempt the rear strop caught the propeller shaft. On dry land it was visible that hefty damage was sustained as stern gland was effectively ripped out.
Boat insurance policy does not cover lift out.
Who is liable for damage?
Should the lift out operator's insurance be liable?
Has anyone experienced similar issues?

From my experience as a one time self employed Plumber ( now retired) if I was paid to carry out works to someone's home and something went wrong, then it was down to me and my 3rd party insurance to rectify the problem as I was a specialist paid to carry specialist type of work. The same applies to anyone you employ, such as to carry out specialist works like lifting a boat out of the water and returning it into the water. You have employed a specialist to carry out these works and as such they are liable for any damage that might occur during this process. Hope this helps.

The matter did get resolved and you are quite right

What I did also learn is there was a very significant excess.
I would urge all boaters to know prior to a haul out if there insurance covers their boat and I would also ask the operator for evidence of insurance too.
