Right To Navigate Tidal Waters

It is a generally accepted principle in the United Kingdom that we all have a right to navigate tidal waters.
To the best of my understanding this is down to days passed when such waters were more highways than places to escape to.
Now, a chap very kindly reminded me of this recently over a couple of sherberts and raised the issue of Broads Tolls.
I was asked why the people of Great Britain who own boats are charged tolls to navigate what is in effect tidal waters when that right already exists.
I must admit, I replied with a thousand yard stare as he had me completely perplexed and unable to answer.

It was always my understanding that the toll is levied under the harbours act
